Terms and Conditions — WIP Equipment

1. Agreement to Terms

By accessing our website or purchasing from WIP Equipment, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.
 

2. Products & Descriptions

  • We make every effort to accurately describe equipment specifications, dimensions, weight capacities, and pricing. Manufacturer specifications are subject to change without notice.

  • Product images are representative; actual equipment may vary slightly by model year, configuration, or manufacturer updates.

  • We reserve the right to correct pricing or listing errors, even after an order is placed, and will notify you before fulfilling an order affected by such an error.
     

3. Orders & Payment

  • All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order.

  • Payment is due at the time of order unless other financing/payment terms have been agreed to in writing (e.g., invoicing for commercial accounts).

  • Prices are listed in USD and do not include applicable sales tax or shipping unless otherwise stated.
     

4. Shipping & Delivery

Shipping is governed by our separate shipping policy, incorporated here by reference. Delivery timeframes are estimates only and not guaranteed.
 

5. Custom & Special-Order Equipment

  • Custom-built or special-order equipment may require a non-refundable deposit.

  • Lead times for custom orders will be communicated at the time of purchase and are subject to manufacturer delays outside our control.
     

6. Returns, Cancellations & Refunds

  • Due to the nature of freight-shipped industrial equipment, returns must be requested within 7 days of delivery and are subject to a restocking fee of 20%, plus return freight costs.

  • Custom or special-order equipment is generally non-returnable unless defective.

  • Cancellations made after an order has entered production or shipped may be subject to cancellation fees.

  • Refunds, when approved, are issued to the original payment method within 7 business days.
     

7. Warranties

  • Equipment sold by WIP may be covered by the original manufacturer's warranty, where applicable. We are not the manufacturer and do not independently warrant equipment beyond what the manufacturer provides, unless otherwise stated in writing.

  • WIP disclaims all other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose, to the maximum extent permitted by law.
     

8. Limitation of Liability

To the fullest extent permitted by law, WIP Equipment shall not be liable for any indirect, incidental, special, or consequential damages arising from the use, misuse, delivery delay, or inability to use any equipment purchased through our website. Our total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.
 

9. Equipment Use & Safety

Buyer is responsible for ensuring equipment is operated in compliance with applicable safety regulations, OSHA standards, and manufacturer guidelines. WIP is not liable for injury, property damage, or loss resulting from improper use, modification, or maintenance of purchased equipment.
 

10. Intellectual Property

All website content — including text, images, logos, and product descriptions — is the property of WIP Equipment or its licensors and may not be reproduced without permission.
 

11. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
 

12. Dispute Resolution

Any disputes arising from these Terms shall first be addressed through good-faith negotiation. 
 

13. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our website after changes constitutes acceptance of the revised Terms.
